Terms of Use (EULA)

1. Who we are and what this agreement is

"Let's pray" (the "App", "Service") is a free, non-commercial, cross-confessional prayer-coordination app, built primarily for a Ukrainian audience in a wartime context. The default language is Ukrainian; Russian and English are also supported.

• Owner and operator (the "we", "Operator"): the founder of the Lets Pray project - a single natural person, sole data controller, established in Ukraine.
• Contact: privacy@dbau.org (placeholder - confirm before launch).

These Terms are a legally binding agreement between you and the Operator. By downloading, installing, or using the App you confirm that you have read, understood, and agree to these Terms, to the Privacy Policy, and to the Community Standards (rules-v1.0.0). If you do not agree, do not use the Service.

2. Free, non-commercial service "as is"

• The App is provided free of charge, as a gift to the community, with no commercial purpose: no ads, no paid features, no subscriptions, no tracking, no sale of data (used_for_tracking = false for all data).
• The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind (see §11).
• We may modify, suspend, or discontinue the Service (in whole or in part) at any time, using reasonable efforts to give advance notice of material changes. As a free service, we are under no obligation to ensure continuous availability.

3. Eligibility (16+)

The Service is only for individuals aged 16 or older. By registering you confirm your age (age_confirmed_16). This is our GDPR Art.8 age gate and is designed to keep children's special- category data out of the Service entirely. If you are under 16, you may not use the Service.

4. Account and security

• An account is required to create groups, join, and receive reminders. Browsing is possible without signing in (anonymous browsing).
• Sign-in is via Apple, Google, or email + password. We offer Sign in with Apple alongside Google, as Apple requires.
• You are responsible for keeping your account credentials safe and for activity under your account.
• One account is for one real person; do not share access or impersonate others (see §6).

5. Your content: your ownership + a license to display

"Your content" means the prayer groups, prayer texts (title, body), group updates (group_updates), "who this is for" labels (beneficiary_label), and confession/region selections you create or submit.

• You retain all ownership of your content. We claim no ownership of it.
• By posting content, you grant the Operator a non-exclusive, royalty-free, revocable license to store, host, reproduce, translate/localize interface elements, and display your content to other users solely to operate the Service - within the visibility (public / link_only) and anonymity (anonymous / firstname / fullname) settings you choose. This license ends when you delete the content or your account, except for copies in backup archives (which expire within the 30-35-day backup window) and minimal moderation records (see the Privacy Policy).
• Prayer content by its nature often reveals religious beliefs and health data (GDPR Art.9 special categories) - both yours and those of third parties. By submitting such content you confirm you do so knowingly (see §§6-7 and the Privacy Policy).

6. Acceptable-use rules (Community Standards)

The Service is a place for sincere prayer. Grief, illness, death, war, fear, prayer for enemies and for peace are the POINT of the App, not a violation. At the same time, to protect people (especially named third parties and people in wartime), mandatory rules apply. They mirror the machine-readable Community Standards (docs/moderation/rules.v1.json, version rules-v1.0.0) and are applied identically by human moderators and the AI classifier (which only advises - a human always decides).

Banned outright (with the internal reason_code):

1. Hate / "prayer against" a person, church, or group (hate) - incitement or discrimination by religion, confession, ethnicity, nationality, language, gender, orientation, or disability; imprecatory prayer against a specific confession, church, or group. Praying FOR a group is allowed.
2. Harassment / targeting of a named private individual (harmful).
3. Threats / incitement to violence (harmful).
4. Operational-security (OPSEC) breaches (opsec_risk) - a safety-of-life rule: disclosing or requesting military unit locations/movements, named service members tied to a place/date, air-defense or checkpoint positions, strike results/locations, or mobilization specifics. Default posture: redact-or-reject.
5. Sexual / explicit content; CSAM (harmful) - zero tolerance for child sexual abuse material (immediate removal, ban, evidence preservation, reporting to authorities).
6. Promotion of self-harm / suicide (harmful). BUT a person asking for prayer in distress is allowed: we show a crisis-resources card (Lifeline Ukraine 7333) and route the request to a human moderator quickly. A person in crisis is never punitively banned.
7. Fundraising / money solicitation / scams (money) - the app is free; money requests in groups are banned (IBANs, card numbers, crypto wallets, payment handles, donation-jar links). This blocks the "sick-child, send money" scam vector.
8. Medical misinformation (medical_misinfo) - advice to refuse treatment, "miracle cures", anti-vaccine claims. Praying for healing is allowed.
9. Impersonation of clergy / parish / organization (impersonation).
10. Political mobilization disguised as prayer (political) - partisan campaigning, candidate endorsement. National intentions (peace, ending corruption, for the country's leaders) are allowed.
11. Spam / duplicates / advertising (spam).
12. Illegal content (harmful) - anything illegal under Ukrainian law or Apple policy.

Special rule on third parties and minors (critically important): because prayers often concern other, non-consenting people (e.g., a sick relative) and we cannot obtain their consent, you must minimize their identification:

• Do not state a third party's full name together with their condition/illness or location. By default use initials or a relationship ("my mother"). The "who this is for" field (beneficiary_label) defaults to this; there are no structured fields for full name/diagnosis/ hospital, by design.
• Take special care with children as the subject of a prayer (minor-beneficiary).
• You confirm (via an attestation at group creation) that you have permission to name the person or that you removed identifiers.
• Any person (even without an account) may file a takedown request about content concerning them via a no-account form: https://pray.dbau.org/g/{id}/concern (GDPR Art.17).

7. Mandatory moderation + UGC duties (Apple requirements)

• Every group is human- and/or AI-reviewed BEFORE it goes live (state PENDING_REVIEW). The AI only flags and raises priority - no sensitive category is ever auto-rejected; a human always makes the final decision. If the AI service is unavailable, the item is routed to human review (never auto-approved or auto-blocked by itself).
• Nine sensitive categories (health, death, missing, captive, minor-beneficiary, opsec, money, clergy-impersonation, sectarian-political) always route to a human moderator.
• As Apple requires for user-generated-content apps, we provide:
  1. Filtering of objectionable content (pre-publication moderation + the rules in §6);
  2. A reporting mechanism on groups/updates/profiles directly in the App;
  3. The ability to block abusive users;
  4. A zero-tolerance policy for objectionable content and behavior (including CSAM);
  5. A published contact: privacy@dbau.org (confirm), and we act on reports and remove violators within a reasonable time.
• Our moderation rights: we may, at our discretion, approve, request changes, edit/redact, reject, or remove any content and suspend or terminate an account for violations. Decisions are recorded in an immutable audit log. An appeal path is available (contact the address above).

8. Suspension and termination

• You may stop using the Service at any time and delete your account in-app (Settings → Account → Delete; for Apple sign-in we revoke the Apple token). Deletion details and timelines are in the Privacy Policy.
• We may suspend or terminate your access for violations of these Terms or the Community Standards, for risk to others' safety, or as required by law. Where feasible we will state the reason.
• Provisions that by their nature should survive (IP, warranty disclaimer, limitation of liability, governing law) survive termination.

9. Service intellectual property

The name, logo, design, code, and content of the App itself (other than user content) belong to the Operator. You receive a limited, personal, non-transferable license to use the App under these Terms and under the standard Apple EULA (§13).

10. No medical, legal, psychological, or "spiritual outcome" promised

• The Service does not provide medical, legal, psychological, or professional advice. Prayer content is not such advice. We promise no outcome - medical, spiritual, or otherwise (healing, answered prayer, etc.).
• If you or someone near you is in danger or crisis, contact emergency services or Lifeline Ukraine 7333 (24/7 psychological support). The Service is not a substitute for professional or emergency help.

11. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind (express or implied), including fitness for a particular purpose, uninterrupted or error-free operation, accuracy, or security. You use the Service at your own risk. We do not guarantee that reminders will always arrive on time (e.g., due to wartime connectivity outages or iOS limits).

12. Limitation of liability

To the maximum extent permitted by Ukrainian law:

• The Operator is not liable for indirect, incidental, punitive, or consequential damages, data loss, or moral/emotional harm arising from use of the Service, other users' content, missed reminders, or Service unavailability.
• The Operator's aggregate liability (if any arises despite the above) is limited to UAH 0 (zero), as the Service is provided free of charge as a gift.
• Nothing in these Terms limits liability that cannot be excluded by law (e.g., for intent or gross negligence where applicable).

13. Apple standard EULA (Licensed Application End User License Agreement)

If you downloaded the App from the Apple App Store, these Terms are your EULA. To the extent of any conflict with Apple's standard Licensed Application End User License Agreement, these Terms prevail, but not below the minimum terms Apple requires. In particular, you acknowledge:

1. Parties. The EULA is between you and the Operator (not Apple). Apple is not a party.
2. Scope of license. The license is personal, non-transferable, to use the App on Apple-branded devices you control, per the App Store Terms of Service Usage Rules.
3. Maintenance and support. The Operator is solely responsible for support; Apple has no obligation to furnish maintenance or support.
4. Warranty. The Operator is responsible for any warranty (where applicable); upon failure to conform, Apple may refund the purchase price (UAH 0 for a free app).
5. Product claims. The Operator, not Apple, is responsible for product claims (product liability, legal/regulatory non-conformity, consumer protection).
6. Third-party IP rights. The Operator, not Apple, is responsible for any claim that the App infringes a third party's IP rights.
7. Export / sanctions compliance. You represent you are not in a U.S.-embargoed country and not on any prohibited-party list.
8. Operator contact. Questions about the App go to privacy@dbau.org (confirm).
9. Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right (and are deemed to have accepted the right) to enforce these Terms against you as the end user.

14. Governing law and disputes

• These Terms are governed by the law of Ukraine.
• Disputes are resolved in the competent courts at the Operator's location (Ukraine), unless mandatory law provides otherwise (including the mandatory consumer rules of your country of residence for EU users).

15. Changes to these Terms

We may update these Terms. We will notify you of material changes in-app and/or by email and update the "Version" and "Effective" date. Continued use after the effective date constitutes acceptance. Each version is tied to an immutable policy version (consent proof - the consents table).

16. Miscellaneous

• Severability: if any provision is held invalid, the rest remain in effect.
• Entire agreement: these Terms, together with the Privacy Policy and the Community Standards, are the entire agreement between you and the Operator regarding the Service.
• No waiver: our failure to enforce any right is not a waiver of it.

Note on processors / international transfer: The full list of processors and recipients - including Anthropic (Claude API, model claude-haiku-4-5), to which prayer title + body (Art.9 religion + health, possibly third-party) are sent for AI moderation classification at api.anthropic.com (an international transfer Ukraine → US of special-category data, under zero-retention / no-training-on- API-data terms plus a DPA/SCCs), as well as Apple APNs (push delivery), Apple + Google (federated login), and an ESP (verification/reset email, provider not yet chosen) - is set out in the Privacy Policy and docs/legal/records-of-processing-art30.md. These Terms incorporate the Privacy Policy by reference.
